दीपक मिश्रा से पहले इन जजों के खिलाफ लाया गया महाभियोग, जानें क्या हुआ था हश्र

नई दिल्ली: भारत के चीफ जस्टिस दीपक मिश्रा के खिलाफ कांग्रेस सहित सात राजनीतिक दलों की ओर से लाए गए महाभियोग प्रस्ताव को उपराष्ट्रपति वेंकैया नायडू ने खारिज कर दिया है. देश के चीफ जस्टिस के खिलाफ महाभियोग का यह पहला प्रस्ताव था, लेकिन इसे उपराष्ट्रपति ने खारिज कर दिया. ऐसे में कई लोगों के जेहन में सवाल उठ रहे होंगे कि आखिर अपने देश में न्यायपालिका में अहम पदों पर बैठे लोगों के खिलाफ महाभियोग प्रस्ताव अब तक कितने बार आया है और उसका क्या हश्र हुआ है. आइए अब तक आए महाभियोग प्रस्ताव पर एक नजर डालते हैं.

1993 में आया पहला महाभियोग प्रस्ताव
आजाद भारत में पहली बार किसी न्यायाधीश को पद से हटाने की कार्यवाही मई 1993 में प्रधानमंत्री पी वी नरसिंह राव के कार्यकाल में हुई थी. उस समय उच्चतम न्यायालय के न्यायाधीश वी रामास्वामी के खिलाफ लोकसभा में महाभियोग प्रस्ताव पेश किया गया था. उनके खिलाफ 1990 में पंजाब एवं हरियाणा हाईकोर्ट के मुख्य न्यायाधीश के पद पर रहते हुये भ्रष्टाचार के गंभीर आरोपों के आधार पर पद से हटाने के लिये महाभियोग प्रस्ताव पेश किया गया था. हालांकि यह प्रस्ताव लोकसभा में ही पारित नहीं हो सका था.

2015 में भी हाईकोर्ट के जज के खिलाफ लाया गया महाभियोग
इसके बाद, तेलंगाना और आंध्र प्रदेश हाईकोर्ट के न्यायाधीश सी वी नागार्जुन रेड्डी और गुजरात हाईकोर्ट के न्यायाधीश जे बी पार्दीवाला के खिलाफ भी महाभियोग की कार्यवाही के लिये राज्यसभा में प्रतिवेदन दिये गये. न्यायमूर्ति पार्दीवाला के खिलाफ तो उनके 18 दिसंबर, 2015 के एक फैसले में आरक्षण के संदर्भ में की गयी टिप्पणियों को लेकर यह प्रस्ताव दिया गया था. लेकिन मामले के तूल पकड़ते ही न्यायमूर्ति पार्दीवाला ने 19 दिसंबर को इन टिप्पणियों को फैसले से निकाल दिया था.

मध्य प्रदेश हाईकोर्ट के न्यायाधीश एस के गंगले के खिलाफ वर्ष 2015 में एक महिला न्यायाधीश के यौन उत्पीडन के आरोप में राज्यसभा के सदस्यों ने महाभियोग प्रस्ताव का नोटिस सभापति को दिया था. इस प्रतिवेदन के आधार पर न्यायाधीश जांच कानून के प्रावधान के अनुरूप समिति गठित होने के बावजूद न्यायमूर्ति गंगले ने इस्तीफा देने की बजाय जांच का सामना करना उचित समझा. दो साल तक चली जांच में यौन उत्पीडन का एक भी आरोप साबित नहीं हो सकने के कारण महाभियोग प्रस्ताव सदन में पेश नहीं हो सका.

7 दलों ने दिया था CJI दीपक मिश्रा के खिलाफ महाभियोग प्रस्ताव का नोटिस
बीते 20 अप्रैल को कांग्रेस और छह अन्य विपक्षी दलों ने देश के प्रधान न्यायाधीश पर ‘कदाचार’ और ‘पद के दुरुपयोग’ का आरोप लगाते हुए उनके खिलाफ महाभियोग प्रस्ताव का नोटिस दिया था. महाभियोग प्रस्ताव पर कुल 71 सदस्यों ने हस्ताक्षर किए थे, जिनमें सात सदस्य सेवानिवृत्त हो चुके हैं. महाभियोग के नोटिस पर हस्ताक्षर करने वाले सांसदों में कांग्रेस, राकांपा, माकपा, भाकपा, सपा, बसपा और इंडियन यूनियन मुस्लिम लीग (आईयूएमएल) के सदस्य शामिल थे. यह कदम प्रधान न्यायाधीश के नेतृत्व वाली उच्चतम न्यायालय की एक पीठ द्वारा उन याचिकाओं को खारिज किये जाने के एक दिन बाद आया, जिनमें विशेष सीबीआई न्यायाधीश बी एच लोया की मृत्यु की स्वतंत्र जांच की मांग की गई थी.

Maharashtra council polls: BJP win marketed on demonetisation, but statistics are being twisted

Now that the results of the municipal councils and town panchayats are out, a lot of political meanings can be found in them.

For instance, the Bharatiya Janata Party (BJP) won the maximum number of councils, seats, and even directly elected presidents, which shows BJP’s demonetised policy as being accepted by the people. This analysis falls by the wayside when the number of such gains are smaller than the victories of the BJP, Congress, and NCP added up — they all have opposed demonetisation.

BJP could well use this as a kind of public opinion in favour of demonetisation, a kind of a mini-referendum in a major state ruled by it. But that would be twisting the statistics, seeking comfort in the fact that it has not won the majority of the council and majority of councillors. By glossing over it, a perception would be sought to be conveyed that despite hardships of not getting speedy replacement of currencies which are now not legal tender.

PM in Lok Sabha: GST will make 'kuchcha' bills a thing of the past

NEW DELHI: Implementation of a goods and services tax will end "tax terrorism"+ , incentivise traders to maintain clean accounts, make "kuchcha bills" (informal bills) a thing of the past and empower the customer, PM Narendra Modi said on Monday.

A "pucca bill" (proper receipt) will help traders claim tax credit and an online system will track transactions at every stage, making it possible to detect evasions, the PM said. He emphasised that the reform+ would mean "customer is king" as the common man will benefit from a more accountable tax regime and an efficient economy.

Modi's kuchcha-pucca remark in Lok Sabha was a reference to the all too common practice of retailers and service providers offering customers a choice of a printed bill or just an informal total that does not contain a tax component. The GST, Prime Minister Narendra Modi said, will put paid an end to this illegality as traders will benefit from preparing a clean bill of goods.

In his intervention in Lok Sabha, which cleared amendments to the Constitution passed by Rajya Sabha+ last week, Modi credited Parliament, political parties and states for putting "rashtraniti" (national policy) above "raj niti" (politics). "The important thing is that this should not be decided on majority, we never wanted it.... We know that unprecedented consensus has been created. It helps in streng thening democracy," he said.

Apart from a few small digs at Congress when he pointed out that the party may have given birth to the bill but it was NDA that nurtured it, Modi stuck to eulogising the strong consensus in favour of the bill even as he defended himself against the charge that as Gujarat CM he had opposed the law. He had apprehensions and had met then finance minister Pranab Mukherjee several times.


"As PM, having experience of CM, I could easily address the concerns of GST," he said. Besides, he said there was a need to develop confidence among states as many of them had apprehensions about the Centre compensating them for possible loss of revenue.


Countering doubts raised by Congress that GST will spur inflation, Modi said the government has made a legal commitment to maintaining inflation at 4%. The government is looking to introduce GST -the most comprehensive indirect tax reforms since independ ence which will result in close to a dozen taxes getting merged into a single tax and turn India into a common market from April next year.

Arun Jaitley's GST Lesson For BJP MPs A Day Before Parliament Debate

As the much-awaited Goods and Services Tax Bill (GST) to amend the Constitution is likely to be taken up in Rajya Sabha on Wednesday, Finance Minister Arun Jaitley today briefed BJP lawmakers on the fine prints of India's biggest tax reform in decades.

He also informed them about the amendments the government will introduce in the Rajya Sabha tomorrow, and also the reasons why the government decided to make those changes.

Mr Jaitley, according to sources, has told the BJP lawmakers to read and understand the bill and follow the proceedings to counter the misgivings, if any, about the GST in their constituencies

The Congress is expected to carry out a similar awareness drive for its MPs.

Meanwhile, the two major parties in the house - the Congress and the BJP - have issued a whip to their lawmakers "to be in the house everyday till Thursday".

The BJP is planning to field speakers who can make strong pitch for the bill and highlight how the NDA government worked with states and parties to make the bill people and business friendly.

Former finance minister P Chidambaram will brief the Congress lawmakers. The party speakers, while backing the GST, are expected to flag that the bill primarily came from the Congress and it was the BJP which opposed it then.

The Congress, during the debate, is likely to emphasise on how hard the party bargained to ensure that the GST rate remains low and also the redressal mechanism with greater say for states.

The GST could get the Rajya Sabha nod on Wednesday with the main opposition party, the Congress, declaring that it has arrived at "a broad understanding" with the government after months of negotiations.

There was last lap tussle over when the bill would be taken up. Government wanted the GST to be debated and voted on Tuesday , but the Congress forced a delay to Wednesday because the party chief Sonia Gandhi and other senior Congress leaders are campaigning in Varanasi, the constituency of Prime Minister Narendra Modi today.

But the 24 hour delay now seems worth the wait as the Congress 'Anand Sharma on Tuesday said, "All the issues we have raised are there in the GST constitutional amendment," he was referring to the proposal that will change the constitution to introduce the GST, a national sales tax which subsumes a complex matrix of central and state tariffs.

The Congress has been talked out of insisting that the limit on the tax rate be stated in the law. That would require changing the constitution each time the rate had to be revised. "On the capping (on GST rate) we still want ring fencing and states to come to an agreement with the centre," Mr Sharma said.

GST could add up to two percentage points to economic growth, according to Mr Jaitley, who has led consultations with state governments, regional parties and the Congress to win consensus.

The GST Bill was cleared last year by the Lok Sabha, where the government has an easy majority. On Wednesday, it must get the support of two thirds of the Rajya Sabha, which has 243 members.

The Congress has the biggest presence with 60 members. With a slew of regional parties backing the reform, the government believes it can get 162 votes - what it needs to turn the proposal into law - even if the Congress is not on board.

But the Congress' cooperation is needed so that it does not cause disruptions to ensure the bill is not debated - a practice it has exercised in earlier sessions of parliament.

Lok Sabha clears amendments in Lok Pal Act

The Lok Sabha on Wednesday cleared amendments to the Lokpal and Lokayuktas Act, 2013, pertaining to dilution of Section 44 of the Act dealing with disclosure of assets of spouses of public servants and those holding positions on the boards of non-governmental organisations (NGOs).

In an unprecedented step, neither the copies of the amendments were circulated to the MPs, nor the Union cabinet had approved them ahead of introduction. Prime Minister Narendra Modi invoked special powers, vested to him to approve the Bill without the Cabinet clearance. The amendments will restrict the declaration only of the assets and liabilities of the public servants only, sparing their spouse and dependent children. The amendments will also seek to do away with this proactive disclosure requirement. The public servants includes the government officials, political functionaries that is the Prime Minister, Ministers and also the Members of Parliament.

Minister of state in the Prime Minister’s Office (PMO) Jitendra Singh moved the amendments, which was not listed in the business list, assuring the members that a Standing Committee of Parliament will be looking into the amendments in any case. The amendment were cleared without discussion amidst protests from the Opposition benches. On the urgency, the minister said since the date of filing such returns was July 30, it has become necessary to address the impasse.

The Confederation of Indian Industry (CII), and several members of Parliament, including nominated member Anu Agha and independent MP in the Rajya Sabha Rajeev Chandrashekhar had raised concerns over the income disclosure clause for trustees and board members of NGOs. According to the minister civil servants, mostly lady officers had also raised the issue that the spouses were working elsewhere and they were not very clear whether they should be asked to make it public and declare the assets.

While the Congress and the Left parties agreed that there was an 'urgency' to pass the bill, they urged that the government should be stringent in imposing the provisions of the bill. Opposition leaders including Mohammad Salim of CPM objected to the introduction of the Bill saying that due parliamentary process was not followed.

As per the rules notified under the Lokpal and Lokayuktas Act 2013, every public servant shall file declaration, information and annual returns pertaining to his assets and liabilities as well as for his spouse and dependent children on March 31 every year or on or before July 31 of that year. In April, the government had extended the date of filing returns by public servants from April 15 to July 31. This is the fifth extension in the deadline since the Act came into force in January 2014.

As per rules, organisations receiving more than Rs1 crore in government grants and donations above Rs10 lakh from abroad fall under the ambit of Lokpal.

GST Bill: Good job Cabinet, it's only a matter of time now

A day after the meeting of the Empowered Committee of State Finance Ministers raised its concerns about the GST Bill, the Cabinet cleared the changes in the Constitutional Amendment Bill in line with the demands made by the panel, clearing the way for the much-needed tax reform to be passed in the current Parliament session.

The move by the Cabinet, chaired by prime minister Narendra Modi, is commendable for the swift action taken and shows the seriousness of the NDA government in taking up the reform process, according to experts.

On Wednesday, the Cabinet approved the dropping of the 1 percent additional manufacturing tax and also provided guarantee to compensate states for any revenue loss in the first five years of the rollout of the proposed indirect tax regime.

“It is indeed commendable that the Cabinet has taken up the GST matter within a day of the meeting of the Empowered Committee of state finance ministers. This depicts the resolve and commitment of the Government to move ahead on GST," MS Mani, Senior Director – Indirect Tax, Deloitte Haskins & Sells LLP, said in a statement.
"The decision to do away with the 1% tax proposed earlier to compensate the manufacturing states will remove a major aberration in the GST value chain. Further, the statement that the states would be compensated for revenue losses for five years would go a long way in addressing their concerns on a very crucial aspect of the GST process,” he added.

Apart from the Congress party, the 1 percent additional tax has been a bone of contention even for the industry, which termed it a "bombshell" that would defeat the whole purpose of PM Modi's pet Make in India scheme. The levy was introduced to placate manufacturing states such as Gujarat and Tamil Nadu, which would lose revenue on account of the GST.

Pratik Jain, partner at KPMG had told Business Standard that the 1 percent additional tax will compromise the efficiency of the supply chain.

As far as compensation for state governments is concerned, the state finance ministers on Tuesday had said that wording in the Bill needs to be changed to bring about clarity.

"You will be happy to know that unanimously a wording was proposed which is clear that five years and that it will be implemented, a very nice constitutional amendment wording was proposed by the empowered committee which I proposed on the behalf of all the finance ministers. I believe that much of it will be accepted," West Bengal finance minister Amit Mitra, who heads the empowered panel, had told the CNBC-TV18 in an interview.

The Cabinet-approved Bill now provides that the Centre will give 100 percent compensation to states for first three years, 75 percent and 50 percent for the next two years.

With the Centre accepting the changes, the NDA government has indeed made a giant step forward to bring on board all the state governments.

Harishanker Subramaniam, national leader, indirect tax, Ernst and Young, said the Cabinet approval is a "very welcome" step.

"The cabinet's clearance of crucial amendments in the Constitution Amendment Bill in response to Empowered Committee discussions like removal of 1% origin tax, and 5 years compensation to States is indeed very welcome and will pave the way for political consensus and early passage of bill in the monsoon session," he said in a statement.

According to a PTI report, with states on board and the Cabinet approving the amendments, the government is hopeful of passage of the long-pending Goods and Services Tax (GST) Bill in the ongoing monsoon session of Parliament, which ends on August 12.

Narendra Modi manages to win over adversaries, despite punishing schedule

Pema Khandu, the newly sworn-in Chief Minister of Arunachal Pradesh, turned into an admirer of Prime Minister Narendra Modi recently, when he met the latter on Sunday. Obviously Khandu’s liking for Modi has nothing to do with his stint as a rebel of the Congress, who helped form a Nabam Tuki government in the state.

Khandu, after winning the confidence vote in Itanagar, came to Delhi and sought appointments with top leaders of his party – president Sonia Gandhi, and vice-president Rahul Gandhi – and the Prime Minister, in that order. He got none, except with the prime minister.

Once again, the impression of an inaccessible Congress president and vice-president got firmly entrenched among the leaders of Arunachal Pradesh. His meeting with Modi, on the other hand, went off quite well.

A close scrutiny of the prime minister's schedule would reveal details of meetings with Members of Parliament (MPs) cutting across party-lines, indicative of his punishing round the clock schedule.

When he is not in the House, he is engrossed in other meetings – it can be a Cabinet meeting, a Cabinet sub-committee meeting, a floor strategy meeting – and a large part of his schedule in Parliament this Budget session has been devoted to meeting MPs, regardless of their political affiliation.

Parliament observers recall that over the last many years, a meeting between the prime minister and the MPs only happened in a Janata Durbar type setting, where many gathered around the PM. Narendra Modi has changed that trend, and has been meeting MPs individually. He is also accessible to MPs across all parties, and often remains in the Parliament till late in the evening.

A routine day in Parliament begins with the daily briefing meeting with Home Minister Rajnath Singh, External Affairs Minister Sushma Swaraj, Defence Minister Manohar Parrikar, Finance Minister Arun Jaitley, Minister of Urban Development Venkaiah Naidu, Parliamentary Affairs Minister Ananth Kumar, Minister for Transport Nitin Gadkari, and the ministers of state for Parliamentary affairs.

Then there are MPs who meet the prime minister to discuss the routine national, state and political issues.

During Parliament sessions, MPs can come to the prime minister’s chamber, and meet him to discuss important issues. Sources close to the PM said, “Time maybe given to five MPs/ministers per day but so many additional MPs stop by and meet the PM. He seldom says no to those coming.”

MPs who meet the PM are amazed at the manner in which he interacts. For those few minutes, all his attention is only on the conversation. No aides walking in, no phones ringing. “It feels very special that the PM is giving his full attention to us,” said a BJP MP, who also met the PM in Parliament. Due to the composition of the Parliament, it is obvious that more BJP MPs meet the prime minister.

Since the start of the monsoon session, BJP MP’s who have met the prime minister include, Harinarayan Rajbhar (MP from Ghosi in UP), Satish Gautam (MP from Aligarh), Udit Raj (Lok Sabha MP from North West Delhi) and Mahesh Girri (Lok Sabha MP from East Delhi).

Trinamool Congress (TMC) MP from West Bengal’s Bangaon Mamata Thakur also met the Prime Minister. National Democratic Alliance (NDA) MPs like Anant Geete (who is also a Union Minister) and Rajan Vichare from the Shiv Sena, Telugu Desam Party (TDP’s) Venkateswara Rao and Akali Dal’s Prem Chandumajra are among those from the ruling alliance, who have spent time with the Prime Minister.

From the Congress, KC Venugopal and some MPs from Kerala met the PM in Parliament. Venugopal, a former Union Minister, is one of the leading lights of the Congress legislative party in the current Lok Sabha and has been critical of the Prime Minister on every possible occasion. Another Congress MP from Kerala, Anto Antony, too met Modi along with Kerala Congress’ Jose Mani. PAC Chairperson KV Thomas too met the Prime Minister.

Earlier this year, the BJP and the NCP were sparring over the arrest of Chhagan Bhujbal, but that didn’t prevent a healthy and cordial meeting between Sharad Pawar and Narendra Modi in the Parliament during the first half of the Budget session. Another NCP MP, DP Tripathi, met the PM in the start of the monsoon session.

Samajwadi Party's (SP) Naresh Agarwal too met Narendra Modi. It may be recalled that in 2013, Agarwal had made scurrilous comments on Modi that had triggered a controversy. Anglo-Indian Lok Sabha MP George Baker met the Prime Minister to hand over a magazine related to the Anglo-Indian community. Newly nominated Rajya Sabha MPs Dr Subramanian Swamy and Suresh Gopi (with his family) have also met the Prime Minister.

INLD Rajya Sabha MP Ram Kumar Kashyap has met the Prime Minister at the start of the monsoon session.

Though the Prime Minister’s office keeps a detailed record and photographs of his meetings with MPs and senior political leaders, officials are particularly instructed to track the issues raised in these meetings.

Sources in the PMO say that all the issues that come up for discussion in these meetings get a rigorous follow-up by a dedicated team of officials, who have reconciled to the idea of having a gruelling schedule, right from the early morning.

Priyanka Gandhi alone can't revive Congress: Jairam Ramesh

Amid the clamour within a section of Congress for Priyanka Gandhi to take an active political role, senior leader Jairam Ramesh has said no individual has a magic wand to revive the party and a team effort is the only way forward. "I have always believed that the answer to the Congress' revival lies not in one individual but in a collective endeavour," Ramesh said when asked if Priyanka should campaign extensively in the Uttar Pradesh Assembly elections or 2019 Lok Sabha poll is the "right time". "No individual has a magic wand. The magic wand lies in a collective entity called the Congress party. Each of us has a responsibility to contribute to the revival. We cannot sit back and say: 'A' will do this, 'B' will do this and 'C' will do this. I think that era is over," the leader told PTI. "Nobody has a magic wand any more. The magic wand is a collective entity. It's a collective effort, it's a team effort," the Rajya Sabha member said. On whether "delay" in Rahul Gandhi taking over as Congress president is hurting the party's prospects, he said, "I think it (Rahul's taking over) is a last mile issue right now. I think it's only a matter of time. I am not privy to his time- frame, but I am sure it's going to happen sooner rather than later." Ramesh said Congress has taken "the right steps" vis-a-vis Uttar Pradesh elections. For the party to announce a chief ministerial candidate (Sheila Dikshit) almost eight months before the poll is unusual. "So, I think we are learning from our own experience." "This is the first time we are announcing a chief ministerial candidate. We have a new PCC chief. We have a new coordination committee chairman. I think we should now wait for the people who have been appointed to deliver," the Congress spokesperson said on the UP elections.

In GST Reform Breakthrough, Congress OKs Debate, Date TBD: 10 Facts

  1. In a big breakthrough for the government, the Congress, which has been blocking the GST reform, has agreed to a five-hour debate  on the proposal. No date has been set yet, but the agreement allows the bill to be introduced for consideration.
  2. The GST will replace a tangle of tariffs imposed by the Centre and different states. Finance Minister Arun Jaitley has presented it as the most important tax reform in decades.
  3. Most parties have come around to support the bill, including regional heavyweights like Mamata Banerjee's Trinamool Congress and Mulayam Singh Yadav's Samajwadi Party.
  4. But the main opposition party, the Congress, which drafted the proposal when it was last in power, remains non-committal on the negotiations with the government over specifics of the bill.
  5. The GST proposal has been approved by the Lok Sabha but has yet to be greenlit by the Rajya Sabha where the government is in a minority. With regional parties backing the reform, the Congress is likely to be outnumbered.
  6. Because of that, the Congress is expected to either cause disruptions in the House which would prevent the legislation from being taken up, or attack the government on recent political controversies.
  7. As part of its outreach, the government today agreed to the Congress' pitch for a debate on the violence that has seared Kashmir since the killing earlier this month of 22-year-old Burhan Wani, a terrorist commander of the Hizbul Mujahideen. His death has led to massive and continuing clashes between civilians, young stone-throwing protesters, and security forces.  Nearly 40 people have died, and 2,000 been injured.
  8. Tomorrow morning, Anand Sharma and Ghulab Nabi Azad of the Congress are scheduled to meet Finance Minister Arun Jaitley with directions from top leaders on both sides to negotiate compromises on the GST.
  9. The Congress wants the GST to be capped at 18 per cent, it wants the upper limit to be listed in the constitutional amendment that will usher in the reform, it wants the removal of proposed 1% state levy, and it has called for a powerful council to settle disputes on revenue-sharing between states.
